DEFINITIONS:

In the privacy policy and terms & conditions the following definitions are used, such as :

1.Data: Includes non-personal information, personal information, and sensitive data about you that could be used to identify you when you visit or use our mobile application, either directly or indirectly in association with other information. The different types of information categories are as follows:

i) Personal information : 

Full name, date of birth, postal address, country, gender, vaccination status, occupation,travel history, phone verification otp and it also includes other individuals' similar  information submitted by you.

ii) Sensitive Information: 

Includes information specified under Information Technology such as medical history, records & symptoms, passwords, financial information, such as a bank account, a credit card, a debit card, or any other means of payment, and health-related information or any other form of data provided to NeoCheck / NDx for rendering service or for processing, storing under a lawful contract otherwise.

iii) Technical information :

 It includes information gathered through various technologies, such as the Aarogya Setu App, which may use web beacons, as well as website, device, and mobile application usage, type of device or browser, IP address, referring or exit pages, clickstream data, operating system, and other similar information linked via cookies, pixels, and other similar technologies.

iv) Product & service information: 

It includes the registration information, your unique test number, camera to scan the QR code and capture image for data processing, your reviews & feedback for the product and the services.

2. Scope: 

NeoCheck app collects the data from you when you register your details on our mobile application to avail our services. If you decline any form of data requested for registration and test we may not be able to provide access to all our services provided through our mobile application.

 

 

COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION
 

The following categories of User personal information are processed for NeoCheck App (including for dependents through legal guardian’s managed profile):

• Full name

• Date of Birth

• Gender

• Vaccination Status

• Occupation

• Phone verification with OTP

• Country

• Aarogya Setu App Status

• Travel History

• Symptoms

• Medical history

• Age

• Patient relationship

• Aadhar Number 

• Phone number

NeoDx may need to access this personal information to support and maintain the Apps and Services and to provide the Testing Facility with the Services.

To protect your privacy, you should not provide Neocheck / NDx with any information that is not specifically requested or that you do not wish to share.

 

Passive Collection of Unidentifiable Information: Neocheck / NDx Website/apps may collect information about your visits to Neocheck / NDx Website/apps without you actively submitting such information. Unidentifiable information may be collected by us or our third party users for using various technologies, such as cookies, Internet tags, and web beacons. Your Internet browser automatically transmits to Neocheck / NDx Website/apps some of this unidentifiable information, such as the URL of the Website/app you just visited and the browser version your computer is operating. 

 

Passive information collection technologies can make your use of Neocheck / NDx Website/apps easier by allowing Neocheck / NDx to provide better service, customise sites based on consumer preferences, compile statistics, analyse trends, and otherwise administer and improve Neocheck / NDx Website/apps. 

 

Certain features of Neocheck / NDx Website/apps may not work without the use of passive information collection technologies. Information collected by these technologies cannot be used to identify you without additional identifiable information.

 

NeoCheck / NDx will use the personal information you provide through NeoCheck / NDx Website/apps to respond to your questions and to provide you with efficient customer service. After you have entered personal information into a form or data field on a NeoCheck / NDx Website/app, NeoCheck / NDx may use certain identifying technologies to allow that Website/app to "remember" your personal preferences, such as sections of that Website/app that you visit frequently and, if you choose, your user ID. We may also use this personal information to offer you the opportunity to receive notifications regarding NeoCheck / NDx or its affiliates’ products or services or to invite you to participate in surveys about our products.

CONSOLIDATING PERSONAL INFORMATION

NeoCheck / NDx may consolidate the personal information of customers who use NeoCheck / NDx Website/apps. We use this information to help us better design NeoCheck / NDx Website/apps and NeoCheck / NDx products, to communicate information to you, to enhance our marketing and research activities, and to facilitate other business functions.

USER’S DISCRETION ON SHARING OF PERSONAL INFORMATION

You may always limit the amount and type of personal information that NeoCheck / NDx receives about you by choosing not to enter any personal information into forms or data fields on NeoCheck / NDx Website/apps. Some of our online services can only be provided to you if you provide us with appropriate personal information. Other parts of NeoCheck / NDx Website/apps may ask whether you wish to opt-out or opt into our contact lists for offers, promotions, and additional services that may be of interest to you.

 

You may also be provided with preference questions or preference boxes allowing you to indicate that you do not want NeoCheck / NDx Website/apps to use tracking technologies, to "remember" your personal information, such as user IDs or mailing addresses, on return visits. Some Internet browsers allow you to limit or disable the use of tracking technologies that collect unidentifiable information.

ACCESS TO PERSONAL INFORMATION OF THE USER

Personal information can be accessed by a restricted number of NeoCheck / NDx employees, third party processing, plug-ins, storage, etc. with which NeoCheck / NDx may conduct joint programs, and by individuals and entities with whom NeoCheck / NDx contracts to carry out business activities for NeoCheck / NDx. 

 

In addition, NeoCheck / NDx practice requires its contractors to keep your personal information confidential and to use personal information only to perform functions for NeoCheck / NDx.

 

Personal information, including testing information, is processed by NDX for the following purposes:

 

To submit the findings to the ICMR or any other regulatory agency as required by law at the time.

 

When a User contacts NDX directly, to preserve a record of such contact.

 

To provide users with services like technical help and to distribute promotional offers that are relevant to consumers.

 

To keep track of app usage so that NDX may improve the content and functioning of the apps.

Non-Personal Data Associated with NDX Services:

 

Non-personal information refers to data that does not identify a specific person. Information gathered from a user of the NDX is non-personal information.

 

Non-Personal Information Collected by NDX with NDX APP Services:

NDX collects general information about visitors using non-personal information about NDX APP App users. NDX uses non-personal information and shares it with third parties to:

 

Improve NDX goods, services, and Web portal content; generate data about portal users to improve portal performance; and personalise information and services for returning portal visitors.

 

USER CONSENT:

Please be aware that by submitting the information, you are consenting to the collection, use, and disclosure of the information for the reasons described in the privacy notice, our terms of service, and as permitted or required by applicable law.

 

THIRD-PARTY ACCESS TO PERSONAL INFORMATION OF THE USER

As per general rule, NeoCheck / NDx does not share your personal information with third parties, unless it is necessary to conduct a joint program or to carry out a program or activity (such as data storage, analysis, or processing) through a contractor/third party. 

 

NeoCheck / NDx will not disclose your personal information to third parties for those third parties’ marketing purposes, unless you have been provided with an opportunity to opt in or opt out of this disclosure.

 

However, if NeoCheck / NDx sells one of its product lines or divisions, your personal information may be transferred to the buyer so that the buyer can continue to provide you with information and services. If NeoCheck / NDx provides your personal information to individuals and entities which assist us with our business activities, it is NeoCheck / NDx practice to require those individuals and entities to keep your personal information confidential and to use your personal information only to perform functions for NeoCheck / NDx.

 

NeoCheck / NDx reserves the right to disclose your personal information to respond to authorised information requests from government authorities, to address national security situations, or when otherwise required by law.
 

SECURING PERSONAL INFORMATION SHARED WITH NEOCHECK/NDX
 

It is NeoCheck / NDx practice to secure each web page that collects personal information; however, the confidentiality of personal information transmitted over the Internet cannot be guaranteed. We urge you to exercise caution when transmitting personal information over the Internet, especially personal information related to your health. NeoCheck / NDx cannot guarantee that unauthorised third parties will not gain access to your personal information; therefore, when submitting personal information to NeoCheck / NDx Website/apps, you must weigh both the benefits and the risks.

 

In addition, NeoCheck / NDx Website/apps covered by this Privacy Policy will display a warning whenever you link to a Website/app that is not controlled by NeoCheck / NDx or subject to a NeoCheck / NDx Privacy Policy; you should check the privacy policies of such third-party Website/apps before submitting personal information. 

 

Personal information is stored in NeoCheck / NDx common servers and NeoCheck / NDx has reasonable security Practises and Procedures for securing such information.

 

PRIVACY POLICY FOR CHILDREN/MINORS

NeoCheck / NDx does not knowingly collect or use any personal information from Children/Minors (we define "minors" as individuals under 18 but over 13 years of age, and “Children” as those younger than 13 years of age) on NeoCheck / NDx Website/apps. 

 

We do not knowingly allow children to order our products, communicate with us, or use any of our online services. If you are a parent and become aware that your child has provided us with information, please contact us using one of the methods specified below, and we will work with you to address this issue.

 

Minors using products and/or services of either NeoCheck/NDx Website/App shall do so under the guidance of a parent or guardian. NeoDx reserves the right to deny/restrict access to services to those found in violation of the rules. 

 

Data Storage:

We receive data (user ID and password) entered into the Apps and the NDX APP Web Portal before it is safely transported and stored in cloud servers in India. To secure personal information, we have implemented adequate security measures and procedures.

 

USAGE OF CAMERA AND MEDIA STORAGE

The App requires access to the device camera to take and store pictures of the test cassette and record the results, which is then stored on the User’s device. If the User chooses to save the report on the cloud, data is also sent to the Indian Council of Medical Research, in compliance with existing National Regulations relating to tracking and monitoring the spread of COVID-19. The User is not obligated to upload their test results on the cloud.

 

LOCATION INFORMATION NOT COLLECTED

As a part of its routine operation, the App does not collect any information about the location of the user while using their smartphone. Location services are used only if the User chooses to save the report to the cloud server.

 

OFFLINE BY DESIGN

The App works offline and uses the device's Internal Memory Storage or an External Memory Storage (SD card) to store relevant information. The device will require access to either Wi-Fi or Cellular/Mobile Data if the User chooses, using their full discretion, to upload the data to the cloud server and/or to fetch the data saved on the server. These servers are located in India.

 

CORRECTING/DELETING PERSONAL INFORMATION FROM CURRENT CUSTOMER RECORDS 

You may request to remove your personal information from our current customer records or to amend your personal information. Please notify us of your wishes by contacting us in one of the ways specified below. For our record-keeping purposes, we will retain certain personal information you submit.

In all communications to NeoCheck / NDx, please include the email address used for registration (if applicable), the Website/app address, or the specific NeoCheck / NDx program to which you provided personal information), and a detailed explanation of your request.

 

If you would like to delete or amend your personal information and are contacting us by email, please put the "Deletion Request" or "Amendment Request, as applicable, in the subject line of the e-mail. 

 

We will do our best to respond to all reasonable requests in a timely manner.

 

PRIVACY POLICY UPDATE NOTIFICATIONS 

NeoCheck / NDx reserves the right to amend this Privacy Policy without prior notice to reflect technological advancements, legal and regulatory changes, and good business practices. 

 

If NeoCheck / NDx changes its privacy practices, a new Privacy Policy will reflect those changes and the effective date of the revised Privacy Policy will be set forth in this paragraph. 

 

We recommend that you visit this Policy every time you are about to provide NeoCheck / NDx with your personal information.

 

Disclaimer: According to the ICMR, among symptomatic individuals and immediate contacts of confirmed positive cases, home testing by Rapid Antigen Test (RAT) is now advised.

 

Negative Test: Symptomatic patients who have been found to be negative by RAT should be linked to an RT-PCR test centre and then tested by RT-PCR to rule out infection. In the meanwhile, such an individual will be advised to continue with home isolation and medication, as a negative RAT result may not always be a real negative.

 

Positive Test: A positive test should be considered a true positive, and the RT-PCR test is not needed for reconfirmation.

 

Before you start the test, make sure you read the instructions. Individuals should undertake all tests with their own consent and at their own risk, expense, and consequences, and the test results should be uploaded to the ICMR site using the NDX App.

 

Invalid Test: The Rapid Antigen Test (RAT) result is detected as invalid; individuals are advised to repeat the test.

 

Symptomatic individuals who are tested invalid twice should immediately get tested by RT-PCR.

 

NeoCheck Rapid Antigen self testing kit should be used only for symptomatic individuals.
